On Friday 20th August 2010, Honourable Judge N.B. Tuchten of the North Gauteng High Court handed down a landmark decision that will have the effect of drastically restricting online gambling operations within the borders of the Republic of South Africa for the foreseeable future.The surprise ruling supports the long-held belief of the Gauteng Gambling Board that certain activities integral to online gambling transactions are illegal under South African law. • Internet operators who offer on-line gambling (interactive games) to the residents of the Republic.
• A player or a punter who participates in on-line gambling transactions (interactive games).
• Persons, entities or organisations which facilitate the provision of on-line gambling (interactive games) includes:
o Internet service providers
o Financial transaction providers such as banks
• Persons, entities or organisations which advertise or facilitate the advertisement of on-line gambling (interactive games) e.g. radio and television stations, print media, outdoor advertising agencies.
In order to conform to the letter of the law, PokerPros will, forthwith, cease to display or support any form of advertising material designed to promote or encourage any form of online gambling activity. Neither shall we display any active hyperlinks that might serve to facilitate the participation of South African visitors in any such online gaming activities now deemed unlawful within South Africa.
